At common law the wife and children could not sue at all since the cause of action died with the plaintiff--as it still does in the case of defamation. It was legislation in mid-nineteenth century England ("Lord Campbell's Act" 9&10 Vict., c. 93) and America that first entitled survivors to sue for the pecuniary loss to them.
